Japan's Industrial Safety and Health Act (ISHA) requires that when specific hazardous chemical substances are provided or transferred to others, prescribed labels must be affixed to or printed on containers or packaging, and Safety Data Sheets (SDS) must be provided to the recipient. The list of substances subject to ISHA labeling and SDS delivery obligations is maintained by MHLW, covering substances that pose health hazard risks to workers (such as carcinogenicity, skin corrosiveness, and acute toxicity) or safety risks such as explosions and fires, currently comprising approximately 900 or more substances.
Compliance Obligations
Manufacturers, importers, or distributors of substances listed under the ISHA labeling and SDS delivery obligations must affix labels complying with ISHA requirements (including substance name, hazard information, and safety measures) and provide SDS containing the 16 prescribed sections when providing or transferring such substances (or mixtures containing them at or above specified concentrations) to others. Failure to fulfil these obligations may result in administrative guidance or penalties.
