Japan's Act on Confirmation of Release Amounts of Specific Chemical Substances in the Environment and Promotion of Improvements to the Management Thereof (PRTR Law) classifies chemical substances into two categories. Class I Designated Chemical Substances are substances with hazardous properties such as carcinogenicity, reproductive toxicity, or chronic toxicity, or environmental hazard properties including persistence and bioaccumulation, with the potential for significant annual releases. The PRTR Law requires relevant businesses to annually report environmental releases and waste transfers for public disclosure (PRTR System), and to provide Safety Data Sheets (SDS) to employees and downstream users.
Compliance Obligations
Businesses using Class I Designated Chemical Substances in annual quantities of 1 tonne or more (0.5 tonne or more for carcinogens) must annually report to the prefectural governor their releases to the atmosphere, water, and soil, as well as waste transfers; competent authorities compile and publicly disclose this data. Businesses must also provide SDS to employees and downstream users.
Not subject to Class 1 designated chemical substance compliance obligations under PRTP.
