The List of Toxic Chemicals Strictly Restricted in China (2023) was jointly issued by the Ministry of Ecology and Environment, the Ministry of Commerce, and the General Administration of Customs on October 18, 2023. It aims to fulfill obligations under international conventions such as the Stockholm Convention on Persistent Organic Pollutants, the Minamata Convention on Mercury, and the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, while strengthening import and export controls on specific toxic chemicals.
The List was revised based on the aforementioned international conventions and their relevant amendments, with the core objective of imposing strict regulation on chemicals that accumulate in the environment, exhibit bioaccumulation, or pose serious hazards to human health and the environment. The List includes nine categories of internationally high-priority chemicals, such as perfluorooctane sulfonic acid (PFOS) and its salts, perfluorooctanoic acid (PFOA) and its salts, short-chain chlorinated paraffins (SCCPs), decabromodiphenyl ether, etc. It specifies permitted uses for controlled chemicals (exemption periods for certain uses expired at the end of 2023). Beyond the permitted uses listed, laboratory-scale research or use as reference standards are also considered permissible.
Compliance Obligations
Substances listed in this List require the Clearance Notification for Environmental Management on Import/Export of Toxic Chemicals from the Ministry of Ecology and Environment for the import/export, which, upon being verified, shall be submitted by the importer/exporter to the Customs to complete the clearance procedures. Note that the Environmental Management Release Notice for Import/Export of Toxic Chemicals will only be issued for uses explicitly permitted within the scope specficifed in the List.
