The Catalogue of ODS Subject to Import and Export Control was jointly issued by the Ministry of Ecology and Environment, the Ministry of Commerce, and the General Administration of Customs of the People's Republic of China on October 25, 2021, and officially implemented on November 1, 2021. It provides the basis for the lawful implementation of import and export licensing approvals for ozone-depleting substances (ODS) and establishes an import and export licensing management system for the listed substances.
The Catalogue fulfills China's international obligations under the Montreal Protocol on Substances that Deplete the Ozone Layer and its amendments, particularly the Kigali Amendment. It consolidates and replaces the six previous editions, not only covering ozone-depleting substances such as chlorofluorocarbons (CFCs), halons, and carbon tetrachloride (CTC), but also extending the scope of control to include hydrofluorocarbons (HFCs) and their mixtures.
Compliance Obligations
Substances listed in the Catalogue are subject to a licensing system for their import and export. Enterprises engaged in their import and export operations must apply in accordance with the “Administrative Measures for the Import and Export of Ozone-Depleting Substances.” After approval by the National Ozone-Depleting Substances Import and Export Management Office, they shall apply for import and export licenses from the Ministry of Commerce or its authorized licensing agencies. Customs clearance procedures shall be conducted based on these import and export licenses.
Note: The Catalogue prohibits the import/export or prohibit the export of specific substances (e.g., carbon tetrachloride, trichlorotrifluoroethane) for controlled uses*.
*Controlled uses refer to applications such as refrigerants, blowing agents, fire extinguishing agents, solvents, cleaning agents, processing aids, pesticides, aerosols, and expanding agents.
