Toxic chemical substances in Taiwan are regulated under the Toxic and Concerned Chemical Substances Control Act (TCCSCA). They are classified into four classes based on their hazardous properties, including:
Class 1 toxic chemical substances: chemical substances that are not prone to decompose in the environment or that pollute the environment or endanger human health due to bioaccumulation, bioconcentration or biotransformation.
Class 2 toxic chemical substances: chemical substances that cause tumors, infertility, teratogenesis, genetic mutations or other chronic diseases.
Class 3 toxic chemical substances: chemical substances that endanger human health or the lives of biological organisms immediately upon exposure.
Class 4 toxic chemical substances: chemical substances that have endocrine disruptor properties, environmental pollutants or chemicals which endanger human health.
Currently, a total of 845 toxic chemical substances have been designated through updates to the relevant appendices of the Categories and Management of Handling for Toxic Chemical Substances. This includes details on chemical identification, control concentrations, graded handling quantities, toxicity classifications, prohibitions, and allowed uses.
Compliance Obligations
For listed toxic chemicals that exceed the control concentration (w/w), the following main obligations must be met:
1. Licensing: For Class 1 to 3 toxic chemicals that reach the graded handling quantities, activities involving the manufacturing, importing, or selling require a permit; use and storage require registration documentation. For Class 1 to 3 toxic chemicals below the graded operational quantities, only approval is required for manufacturing, importing, selling, using, or storing. Export registration is required for Class 1 to 3 toxic chemicals. Handling activities involving Class 4 toxic chemicals only need approval.
2. Reporting: Handlers must maintain records of operations and release quantities and submit these periodically. Owners of Class 1 to 3 toxic chemicals must declare transport manifest prior to transporting these substances.
3. Prevention and Labeling: Compliance with labeling and safety data sheet requirements is mandatory, along with provisions for emergency equipment, detection alarms, technical personnel, and emergency personnel.
4. Notification: In the event of an accident, handlers must notify local authorities within the designated timeframe and dispatch professional emergency personnel to the scene.
Toxic chemical substances are not applicable for Taiwan's  Regulation of New and Existing Chemical Substances Registration.
