India's List of Toxic and Hazardous Chemicals are specified in Schedule 1, Part II of MSIHC Rule 1989. According to Article 2 of MSIHC Rule, "hazardous chemicals" are defined as:
1. any chemical which satisfies any of the criterias laid down in part I of Schedule 1 or listed in Part II
2. any chemical listed in Schedule 2
3. any chemical listed in Schedule 3
Compliance Obligations
For listed substances, enterprises are obligated to fulfill requirements including submitting a Safety Report, establishing Emergency Plans, adhering to Threshold Quantity controls, and conducting personnel training and health surveillance. Additionally, the import of such chemicals requires prior notification to the authorities at least 30 days in advance.
As the list contains substance groups, comprehensive search is required to verify the regulatory status of the substance. For substances that are not in this list, they are not subject to the requirements under MSIHC (Manufacture, Storage and Import of Hazardous Chemical Rules).
