Persistent Organic Pollutants are regulated worldwide under the Stockholm Convention and the Aarhus Protocol. These international treaties are implemented in the EU through the "Persistent Organic Pollutants Regulation" (POPs Regulation). On June 25, 2019, the EU issued a new version of the "Persistent Organic Pollutants Regulation" (EU) 2019/1021, aiming to protect human health and the environment through specific control measures.
The "Persistent Organic Pollutants Regulation" regulates the following substances:
• Substances in Annex I are prohibited from production, marketing and use (including specific exemptions);
• Substances in Annex II are restricted from production, marketing and use;
• Substances in Annex III must reduce emissions;
• Substances in Annex IV must comply with waste management regulations.
Compliance Obligations
Production, placing on the market and use of the substances listed in Annex I are prohibited except for exemptions listed in the EU POPs Regulation ((EU) 2019/1021). Substances listed in Annex II shall only be used for specific purposes and under specific conditions. For substances listed in Annex III, member states must control and reduce emissions. For substances listed in Annex IV, regulations on waste management must be complied with; waste exceeding content limits must be mandatorily destroyed and shall not be recycled or reused.
